This seminar discusses the differences between the duty to indemnify and the duty to defend, and provides an overview of recommended indemnity provisions, and contractual pitfalls to avoid relating to the duty to defend. We will also examine recent case law interpreting common indemnity clauses, recent legislation addressing a design professional’s duty to defend in public contracts, and a discussion on what triggers a design professional’s duty to defend v. indemnify. | |
