ADR Choice of Forum: The Arbitration Process |

Arbitration is the most trial-like method of Alternative Dispute Resolution, and is the choice forum for parties who still want their day in court. Arbitration generally leads to a quicker end result, and the cost is often less than taking the same dispute through the court system. Although arbitration can be non-binding, the resolution is typically binding, and the risks involved can be limited for both sides through the use of high-low agreements.
At this April roundtable, Jack Connarton, a Litigation Partner in our Professional Practices Group at Donovan Hatem, will lead the discussion on the arbitration process, including:
- The perceived advantages of arbitration
- The scope and validity of the arbitration agreement
- The arbitration forum and its applicable rules including the number of arbitrators, availability of discovery and subpoena power, applicability of rules of evidence, and hearing procedures
- The receipt and enforcement of arbitration awards
- The lack of right to appeal
